Article 1 — Definitions

the Franck Giving website and application accessible through franckgiving.org.
User:
every visitor to or user of the Website.
Services:
all digital products, information and promotional support offered through the Website.
Franck Giving:
Stichting Franck Giving, the initiator of the platform and provider of the Services.

Article 2 — Purpose and social mission

The purpose and social mission of Stichting Franck Giving are described in the Policy Plan 2024–2026.

Article 3 — Applicability

  1. These Terms and Conditions apply to use of the Website.
  2. By using the Website, the User agrees to these Terms and Conditions.
  3. Franck Giving reserves the right to amend these Terms and Conditions at any time. The most recent version will always be available on the Website.

Article 4 — Use of the Website

  1. Users may use the Website only in a manner consistent with Franck Giving’s purpose.
  2. Website content may not be used for commercial purposes without prior written permission from Stichting Franck Giving.
  3. Distributing false information, misusing campaigns or manipulating donations is prohibited and may result in exclusion from participation.

Article 5 — Intellectual property

  1. All rights to Website content, including text, photographs, campaigns, templates and logos, belong to Stichting Franck Giving.
  2. Material may be used only for personal purposes consistent with the foundation’s mission.

Article 6 — Privacy

  1. Personal data is processed in accordance with applicable privacy legislation, including the GDPR. Stichting Franck Giving is not liable for damage arising from use of the Website.
  2. Data is collected and retained only to provide the Services or communicate about campaigns.

Article 7 — Governing law

  1. These Terms and Conditions are governed exclusively by Dutch law.
  2. Disputes should preferably be resolved through consultation. If that is not possible, they will be submitted to the competent court in the Netherlands.
